Gridless Limited Hardware Warranty

What Does the Warranty Cover? 

Thank you for your interest in the products and services provided by Gridless Power Corporation (referred to as “Gridless”) below.

This limited Hardware Warranty guarantees our physical products to be free from defects in workmanship and materials for one year from the date of purchase by the end-user with a maximum of 12 months from the Gridless Invoice date. In addition to this, proof of correct battery usage is required when making a battery warranty claim.

For a fee, an additional 9 years of warranty can be purchased, bringing the total warranty to 10 years. Warranty extensions need to be applied for three months before the expiration of the original term. 

During the warranty period, Gridless will, at its discretion, repair, replace or credit the defective product free of charge. The warranty does not include performing or reimbursing de‐installation, transportation, and re‐installation. 

In order to qualify for the warranty, the product must not be disassembled or modified. This warranty will not apply where the product has been misused, neglected, improperly installed, or repaired by anyone other than Gridless.

Repair, replacement, or credit are our sole remedies, and Gridless shall not be liable for damages, whether direct, incidental, special, or consequential, even when caused by negligence or fault. Gridless shall in no event be liable for consequential, incidental, contingent or special damages, even if having been advised of the probability of such damages. 

If Gridless repairs or replaces a part of a product, its warranty term is not extended. All remedies and the measure for damages are limited to the above. 

Remedy for Breach of Warranty

Customer’s sole and exclusive remedy and Gridless’ (and its suppliers’ and licensors’) sole and exclusive liability for a breach of the Hardware Warranty will be, in Gridless’ sole discretion, to replace the non-conforming Hardware. Replacement may be made with a new or refurbished product or components. If the Hardware or a component within it is no longer available, then Gridless may replace the Hardware unit with a similar product of similar function. Any Hardware unit that has been replaced under the Hardware Warranty will be covered by the terms of the Hardware Warranty for the longer of (a) 90 days from the date of the delivery, or (b) the remainder of the original Hardware Warranty period. Customer’s engaging in a Prohibited Use serves to void the Hardware Warranty.

Warranty Returns

To request a return under the Hardware Warranty, Customer must notify Gridless within the Hardware Warranty period and complete all troubleshooting required. To initiate a return directly to Gridless, Customer must send a return request to:

Customer must clearly state details on where and when Customer purchased the Hardware, the serial numbers of the applicable Hardware unit(s), Customer’s reason for returning the Hardware, and Customer’s name, mailing address, email address, and daytime phone number. If approved, Gridless will provide Customer with a Return Materials Authorization (“RMA”) and prepaid shipping label via email that must be included with Customer’s return shipment to Gridless. Customer must return the Hardware unit(s) listed in the RMA with all included accessories and properly packaged within the 14 days following the day on which Gridless issued the RMA. 

Warranty Repairs

To request a repair under the Hardware Warranty, Customer must notify Gridless within the Hardware Warranty period and complete all troubleshooting required. To initiate a return directly to Gridless, Customer must send a return request to:

Customer must clearly state the details on where and when Customer purchased the Hardware, the serial numbers of the applicable Hardware unit(s), Customer’s explanation of the problem, and Customer’s name, mailing address, email address, and daytime phone number. If approved, Gridless will provide Customer with either a prepaid shipping label via email or physical label with box, hazmat labels and packing instructions that must be included with Customer’s return shipment to Gridless. All hardware must be packaged properly or warranty is voided. 

Out-of-Warranty Repairs

Customer will return hardware in the same manner as in warranty repair. Gridless will evaluate the unit(s) and provide a quote for the price of repair including shipping and service charges. The hardware will be returned to the customer only when the repair bill is settled in full. 

Warranty Exclusions

This warranty will be considered void if the unit has suffered any physical damage or alteration, either internally or externally, and does not cover damages arising from improper use like:

  • Inadequate connections or improper sealing of enclosure.
  • Use of any chargers or solar panels not supplied by or approved by Gridless. 
  • Mechanical shock or deformation or any breach of the battery enclosure not made by Gridless. 
  • Use in an inappropriate environment (excessive dust, corrosive vapor, humidity, high temperature, biological infestation, etc.). 
  • Breakage or damage due to lightning. 
  • For any electronic breakage except due to lightning (reverse polarity, over‐voltage due to external cause).
  • Connection terminals and screws are destroyed or other damages, like overheating, due to insufficient tightening. 

 

LIMITATION OF LIABILITY

IN NO CASE SHALL GRIDLESS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF WARRANTY OR ANY OTHER LEGAL THEORY. SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, LOSS OF SAVINGS OR REVENUE, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT AND COST OF ANY SUBSTITUTE EQUIPMENT, FACILITIES OR SERVICES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

DISCLAIMER OF WARRANTIES

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, GRIDLESS DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, GRIDLESS LIMITS THE DURATION OF AND REMEDIES FOR BREACH OF SUCH WARRANTIES TO THE DURATION AND REMEDIES OF THE EXPRESS LIMITED WARRANTY DESCRIBED ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Consumer Protection

Some states do not allow the exclusion or limitation of incidental or consequential damages or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary by state to state.
